AN ACT to amend Tennessee Code Annotated, Section 43-6-102 and 43-1-703(f), relative to florists.

BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF TENNESSEE:

SECTION 1. Tennessee Code Annotated, Section 43-6-102, is amended by adding the following as an appropriately numbered subdivision:

Florist means an establishment whose primary business is the retail sale of fresh cut flowers; a florist shall not be considered a dealer, provided the sales of rooted plant material sold by such florist shall be those used to enhance fresh cut flower arrangement, or which are intended to be grown and maintained indoors and which are not intended to be planted in the landscape.

SECTION 2. Tenessee Code Annotated, Section 43-1-703(f), is amended by adding the following as an appropriately numbered subdivision:

( ) Florist Certificate: twenty-five dollars ($25);

SECTION 3. This act shall take effect upon becoming a law, the public welfare requiring it.
