AN ACT To amend Tennessee Code Annotated, Title 62, Chapter 18, relative to land surveyors.

BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF TENNESSEE:

SECTION 1. Tennessee Code Annotated, Section 62-18-113, is amended by adding the following new language to the end thereto:

It is the sole responsibility of any person registered as a land surveyor to renew such person's registration on or before the date of its expiration.

SECTION 2. Tennessee Code Annotated, Section 62-18-114, is amended by deleting the section in its entirety and by substituting instead the following:

(a) The board shall notify each person registered hereunder of the date of expiration of such person's certificate and the amount of the fee required for its renewal. Such notice shall be sent at least one (1) month in advance of the expiration of the certificate.

(b) It is the responsibility of any person registered hereunder to notify the board, in writing, of any change of address.

(c) Certificates of registration shall be subject to late renewal for a period of one (1) year following their expiration date by payment of the renewal fee, plus a penalty of twenty dollars ($20.00) or in such other amount as set by the board, for each month or fraction thereof which elapses before payment is received. Any person whose registration has expired for more than one (1) year shall make application for registration; provided, that the board may, in its discretion, waive any further examination of such an applicant.

SECTION 3. Tennessee Code Annotated, Section 62-18-116(a)(1), is amended by adding the following new subdivisions thereto:

(E) Any conviction in a court of competent jurisdiction of a felony;

(F) Any revocation, suspension, disciplinary action, or voluntary surrender of a license or certificate of registration to practice land surveying in any jurisdiction.

SECTION 4. Tennessee Code Annotated, Section 62-18-116(a), is amended by deleting subdivision (2) in its entirety and by substituting instead the following:

(2) Any person may prefer charges against any land surveyor registered hereunder on any of the above grounds. Such charges shall be in writing, sworn to by the complainant, and specifically state the factual basis for such charges.

SECTION 5. Tennessee Code Annotated, Section 62-18-116(3), is amended by deleting subsection (d) in its entirety and by substituting instead the following:

(d) The board shall notify the register of deeds of each county which would likely be affected by the revocation or suspension of a certificate of registration, or the reissuance of a revoked or suspended certificate of registration.

SECTION 6. Tennessee Code Annotated, Section 62-18-117, is amended by deleting the words and figures "five dollars ($5.00)" and by substituting instead the words and figures "fifty dollars ($50.00)".

SECTION 7. This act shall take effect July 1, 1998, the public welfare requiring it.
