AN ACT To amend Tennessee Code Annotated, Section 68-211-835(d), relative to the surcharge on solid waste which is in addition to tipping fees.

BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF TENNESSEE:

SECTION 1. Tennessee Code Annotated, Section 68-211-835(d), is amended by inserting the words "or transfer stations that are not operated in conjunction with a convenience center" between the words "solid waste disposal facilities" and "or incinerators" in the first paragraph of subsection (d).

SECTION 2. Tennessee Code Annotated, Section 68-211-835(d), is amended by inserting the words "or transfer stations that are not operated in conjunction with a convenience center" between the words "solid waste disposal facility" and "or incinerator" in the last paragraph of subsection (d).

SECTION 3. Tennessee Code Annotated, Section 68-211-835(d), is amended by inserting after the first sentence of the last paragraph in subsection (d) the following:

When municipal solid waste is delivered to a transfer station that is not operated in conjunction with a convenience center and subsequently delivered to a solid waste disposal facility or incinerator:

(i) The surcharge pursuant to this subsection (d) shall be collected only once with respect to such municipal solid waste; and

(ii) The operator of such transfer station shall be responsible for the collection and remittance to the state treasury of the surcharge pursuant to this subsection (d) with respect to such waste only if arrangements satisfactory to the department have not been made for the surcharge pursuant to this subsection (d) to be collected by the operator of the solid waste disposal facility or incinerator and remitted to the state treasury.

SECTION 4. This act shall take effect July 1, 1998, the public welfare requiring it.
