AN ACT to amend Tennessee Code Annotated, Title 36, Chapter 6, Part 1, relative to factors to be considered by the court in custody proceedings.

BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF TENNESSEE:

SECTION 1. Tennessee Code Annotated, Section 36-6-106, is amended by adding the following new subsection (10):

(10) Each parent's past and potential for future performance of parenting responsibilities, including the willingness and ability of each of the parents to facilitate and encourage a close and continuing parent-child relationship between the child and the other parent, consistent with the best interest of the child.

SECTION 2. This act shall take effect upon becoming a law, the public welfare requiring it.
