AN ACT to amend Tennessee Code Annotated, §70-2-106(b), relative to establishing an agent fee, through normal competitive bidding contract procedures for the sale of licenses, permits and stamps over the telephone or through other electronic means.

BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF TENNESSEE:

SECTION 1. Tennessee Code Annotated, §70-2-106(b) is amended by adding the following sentence:

In lieu thereof, the executive director is authorized to establish an agent fee, through competitive bidding contract procedures, for the successful bidder to sell licenses, permits and stamps over the telephone or through other electronic means.

SECTION 2. Tennessee Code Annotated, Section 70-2-106(b), is amended by designating the existing language, as amended, as subdivision (1) and by adding the following new subdivisions:

(2) The executive director, the county clerk of each county, and the agents designated and appointed by the executive director as such agents for the sale of licenses, shall offer for sale conservation stamps, including but not limited to full-color waterfowl stamps for a cost of ten dollars ($10.00) each. Any revenues from such stamps over and above the cost of producing and distributing the stamps shall go into habitat improvement. Possession of a stamp is voluntary and is not required in order to hunt, fish or trap.

(3) The General Asssembly shall review and reauthorize the conservation stamp program after it has been in operation for three (3) years.

SECTION 3. If any provision of this act or the application thereof to any person or circumstance is held invalid, such invalidity shall not affect other provisions or applications of the act which can be given effect without the invalid provision or application, and to that end the provisions of this act are declard to be severable.

SECTION 4. This act shall take effect upon becoming a law, the public welfare requiring it.
