AN ACT To amend Tennessee Code Annotated, Title 6, Chapter 3, relative to the Mayor-Aldermanic Charter.

BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF TENNESSEE:

SECTION 1. Tennessee Code Annotated, Section 6-3-106(a), is amended by deleting subdivision (3) in its entirety and substituting instead the following:

(A) Shall make temporary appointments of any officer or department head as those terms are defined in Section 6-1-101, except that of alderman, arising from the absence, sickness or disability of any such officer or department head, and shall report such appointment to the board at its next regular meeting.

(B) The board may confirm or reject the mayor's temporary appointments, or, at its discretion, make its own temporary appointments. The board shall make appointments to fill vacancies in office.

SECTION 2. Tennessee Code Annotated, Section 6-3-108, is amended by deleting the section in its entirety, and by substituting instead the following:

In the absence of the mayor and vice-mayor, the board may elect an alderman to act as presiding officer.

SECTION 3. Tennessee Code Annotated, Section 6-3-106(b), is amended by deleting the first clause of the first sentence which reads, "Unless otherwise designated by the board," and by substituting instead the following new clause: "Unless otherwise designated by the board by ordinance."

SECTION 4. This act shall take effect upon becoming a law, the public welfare requiring it.
