AN ACT to amend Tennessee Code Annotated, Section 63-5-102; Section 63-5-103 and Section 63-5-105, relative to dental assistants.

BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF TENNESSEE:

SECTION 1. Tennessee Code Annotated, Section 63-5-102, is amended by adding the words, punctuation and number "and one (1) practicing registered dental assistant" between the words "hygienist" and "whose".

SECTION 2. Tennessee Code Annotated, Section 63-5-103(a), is amended by adding the following language as a new item thereto:

(3) The dental assistant member may be appointed by the Governor from a list recommended by the Tennessee Dental Assistants' Association. The association may submit the names of two (2) dental assistants, arranged alphabetically, from each grand division from which a board member is to be appointed. No person is eligible for appointment as a dental assistant member of the board unless he or she has been an actual and bona fide resident, and has been a legally registered and practicing dental assistant of this State for a period of five (5) years or more immediately preceding such appointment.".

Tennessee Code Annotated, Section 63-5-103 is further amended in subsection (c)(1) by inserting the words: "or dental assisting" between the words "hygiene" and "or" in the last sentence.

SECTION 3. Tennessee Code Annotated, Section 63-5-105, is amended by deleting subsection (6) in its entirety and by renumbering the remaining subsections accordingly.

SECTION 4. This act shall take effect upon becoming a law, the public welfare requiring it.
