AN ACT to amend Tennessee Code Annotated, Title 62, Chapter 19, Part 1, relative to auctioneers.

BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF TENNESSEE:

SECTION 1. Tennessee Code Annotated, Section 62-19-111(b), is amended by adding the following as a new appropriately designated subdivision:

( ) Obtained a high school diploma or general equivalency diploma (GED);

SECTION 2. Tennessee Code Annotated, Section 62-19-111(h)(1)(B), is amended by adding the following as a new appropriately designated subdivision:

( ) Obtained a high school diploma or general equivalency diploma (GED);

SECTION 3. Tennessee Code Annotated, Section 62-19-106, is amended by adding the following as a new appropriately designated subsection:

( ) The commission shall have the authority to establish continuing education requirements and standards for individual licensees. This shall apply only to those licensees that received their license after January 1, 1985, or any licensee that reaches the age of 60 and has been licensed for at least 10 years. No apprentice is exempt from continuing education..

SECTION 4. Tennessee Code Annotated, Section 62-19-107, is amended by deleting subsection (a) in its entirety and by substituting instead the following language:

(a) The commission shall meet at least one (1) time each quarter of every calendar year for the purpose of transacting such business as may properly come before it.

SECTION 5. Tennessee Code Annotated, Section 62-19-111, is amended by adding the new appropriately designated subsection:

( ) An apprentice auctioneer may be employed by a licensed auctioneer who is not designated as the apprentice's sponsor, upon receiving written permission from the apprentice's sponsor and notifying the commission of such employment in the proper form and manner as prescribed by the rules of the commission. An auctioneer employing an apprentice who is not that auctioneer's sponsor shall be responsible for the actions of the apprentice while under that auctioneer's employment and the sponsor shall be responsible for the actions of the apprentice at all other times.

SECTION 6. Tennessee Code Annotated, Section 62-19-117, is amended by adding subsection (f) as follows:

(f) The Tennessee Auctioneer Commission shall have the authority to impose any fee or licensing requirements on applicants for licenses from a reciprocal state that the reciprocal state imposes on Tennessee licensees by rule, regulation, policy, or law.

SECTION 7. Under this act continuing education will be six hours each renewal period.

SECTION 8. This act shall take effect upon becoming a law, the public welfare requiring it.
