AN ACT To amend Tennessee Code Annotated, Title 63, Chapter 10, to allow pharmacists to join together in buying consortiums.

BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF TENNESSEE:

SECTION 1. Tennessee Code Annotated, Title 63, Chapter 10, Part 4, is amended by adding a new section thereto as follows:

Section 63-10-411. It shall not be a violation of any state law relative to restraint of trade, anti-trust, or any provision of the licensing laws for pharmacists, pharmacies, wholesalers, distributors, or manufacturers under Section 63-10-506, for pharmacists, independently or through any pharmacist or pharmacy, to form a consortium for the purpose of making bulk purchases of drugs or other medical equipment and supplies for the purpose of resale in their pharmacies.

SECTION 2. This act shall take effect upon becoming a law, the public welfare requiring it.
