AN ACT
To amend Tennessee Code Annotated, Title 50, Chapter 6, relative to workers' compensation coverage.BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF TENNESSEE:
SECTION 1. Tennessee Code Annotated, Section 50-6-102(a)(4), is amended in the first sentence by inserting between the language "five (5) persons for pay," and the language "and in the case" the language "except as provided in Section 50-6-113,".
SECTION 2. Tennessee Code Annotated, Section 50-6-106(4), is amended by inserting between the language "are regularly employed" and the punctuation ";" the language "except as provided in Section 50-6-113".
SECTION 3. Tennessee Code Annotated, Section 50-6-113, is amended by adding the following as a new subsection (f):
(f) All subcontractors and anyone engaged in the construction industry shall be required to carry workers' compensation insurance. This requirement shall apply whether or not said party has five (5) employees or not. Sole proprietors and partners shall not be required to carry workers' compensation insurance on themselves.
SECTION 4. The provisions of this act shall not apply in counties having a population, according to the 1990 federal census or any subsequent federal census of:
