AN ACT to amend Tennessee Code Annotated, relative to agency rules scheduled to expire pursuant to the provisions of the Uniform Administrative Procedures Act contained within Tennessee Code Annotated, Title 4, Chapter 5.

BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF TENNESSEE:

SECTION 1. Except as provided in subsection (c), all permanent agency rules duly filed in the office of Secretary of State between January 1, 1996, and December 31, 1996, which are in effect on the effective date of this act, and which are scheduled for expiration by the provisions of Tennessee Code Annotated, Section 4-5-225, on June 30, 1997, shall not expire on June 30, 1997, but shall remain in effect until repealed or amended by subsequent rule of the appropriate rulemaking agency or until otherwise superseded by force of law.

(b) The provisions of this section shall not be construed to justify the continued effectiveness of any rule included within the provisions of subsection (a) if such rule conflicts with the provisions of any enactment other than Tennessee Code Annotated, Section 4-5-225.

(c) The following rules duly filed in the office of Secretary of State between January 1, 1996, and December 1, 1996, shall expire and shall not remain in effect after June 30, 1997:

(1) Rule 0480-1-.06(4) - Tennessee Board of Dispensing Opticians - Fees;

(2) Rule 0260-2-.06 - Board of Chiropractic Examiners - Fees;

(3) Rule 0260-3-.06 - Board of Chiropractic Examiners - Fees;

(4) Rule 1000-1-.12 - Board of Nursing - Fees;

(5) Rule 1050-2-.02 - Board of Osteopathic Examination - Schedule of Fees; and

(6) Rule 0800-2-.02 - Board of Medical Examiners - Fees.

(7) Rule 0530-2-1-.03 - Registry of Election Finance - Bookkeeping Procedures;

SECTION 2. This act shall take effect upon becoming a law, the public welfare requiring it.
