AN ACT to amend Tennessee Code Annotated, Section 53-10-104 and Section 63-7-123, relative to expanding prescriptive authority for certain nurse practitioners.

BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF TENNESSEE:

SECTION 1. Tennessee Code Annotated, Section 53-10-104(a), is amended by deleting subdivision (2) in its entirety.

SECTION 2. Tennessee Code Annotated, Section 63-7-123(b), is amended by adding a new subsection (2) and renumbering the subsections accordingly:

(2) The nurse practitioner who holds a certificate of fitness shall be authorized to prescribe and/or issue controlled substances listed in Schedules II, III, IV and V of Tennessee Code Annotated, Title 39, Chapter 17, Part 4, upon joint adoption of physician supervisory rules concerning controlled substances pursuant to Section (d) of this act.

SECTION 3. If any provision of this act or the application thereof to any person or circumstance is held invalid, such invalidity shall not affect other provisions or applications of the act which can be given effect without the invalid provision or application, and to that end the provisions of this act are declared to be severable.

SECTION 4. Nothing in this act shall apply to the practice of nurse anesthesia.

SECTION 5. This act shall take effect July 1, 1997, the public welfare requiring it.
